As previously reported by FAEP, the internet revolution and media convergence is inspiring Brussels regulators to interfere – the result of ongoing debates on how to protect children from illegal and harmful content, how to protect users’ privacy and ensure data protection, how to tackle piracy and how to empower consumers.

Current thinking is that the rules which apply to the off-line world are no longer suitable for online. Concretely, the Commission intends to propose a decision to promote safer use of the Internet and new online technologies in the coming months. The fear is that it could lead to content control over the Internet and go against the fundamental freedom of expression.

In parallel, the proposed Google/Double click merger has highlighted concerns related to personal data protection and new advertising techniques based on profiling. Apart from the many press articles on these issues, the Commission has started to investigate on two levels: consumer awareness and data protection.

The question of the use of cookies will be without doubt part of the discussions. So far, the applicable legislation at European level is confusing as it does not draw a clear line between cookies and spywares, which are formally forbidden by law.

If developing online activities is challenging for publishers, it will certainly not only be due to business models and readers’ expectations, but also about making sure regulation guarantees freedom of expression and the possibility to make targeted advertising.
